Probate is an official sounding term which refers to an order made by the court which confirms:

  • The Will of the deceased is valid; and
  • The Executor appointed in the Will has the authority to collect assets, extinguish liabilities of the estate, and distribute proceeds of the estate to beneficiaries so named in the Will.

A Grant of Probate is a legal document, provided by the court, which enables the Executor of the Will to finalise the deceased person?s financial and legal affairs.

The time required to obtain the Grant of Probate is usually a function of the complexity of the deceased?s financial and legal affairs.
